FKC Electronics and Logistics Services Inc. takes the highest level of security measures to ensure that your personal data is collected, stored and shared in accordance with the law and to protect your privacy. Our aim is to inform you in the most transparent manner, in accordance with Article 10 of the Turkish Personal Data Protection Law No. 6698 and in line with your satisfaction, about the ways in which your personal data is collected, the purposes of processing, the parties with whom it is shared, the legal reasons and your rights.
a) Data Controller
In accordance with the Turkish Personal Data Protection Law No. 6698 ("Law No. 6698"), your personal data may be collected and processed by FKC Electronics and Logistics Services Inc. ("the Company") as the data controller within the scope set out below.
b) Purposes for Which Personal Data Will Be Processed
The Company may collect personal data in categories such as identity, contact, customer, customer transaction, transaction security, legal transaction and compliance, and marketing and sales information from parties such as customers, employees, potential customers, job applicants, business partners and suppliers. Your personal data collected will be processed within the conditions and purposes specified in Articles 5 and 6 of Law No. 6698 for the following purposes:
- To provide you with the Company's products and services, to fulfil our obligations towards you, to prepare records and documents, and to comply with information retention, reporting, notification, tax and other obligations required by local and international legislation;
- To offer you personalised advertising, campaigns, benefits and other advantages for sales and marketing activities aimed at improving the quality of services and products;
- To manage infrastructure and business activities and to comply with internal policies and procedures, including those related to audit, finance and accounting, billing and collections, IT systems, data and website hosting, business continuity and records, document and print management;
- To communicate with you for the purpose of conveying necessary information regarding IT requirements, system structure, the necessity of IT support services received, and these services and products;
- To carry out traffic measurement, statistical analyses, segmentation/profiling and CRM activities for sales and marketing activities;
- To measure and increase customer satisfaction, manage complaints, receive your opinions and suggestions regarding new services and products, receive your problem and fault reports, and provide you with information regarding products, services, complaints and requests;
- To receive your orders, carry out your payment transactions, cooperate with third parties for logistics and ensure product delivery, to recommend products and services that may interest you, for online behavioural advertising and marketing, customer portfolio management, measurement and improvement of service quality, communication, optimisation, audit, risk management and control, promotion, analysis, determination of interests, scoring, profiling, marketing, sales, advertising and communication;
- For comparative product and/or service offers, modelling, existing or new product studies and/or developments, and for use in all kinds of products and services to be offered to you within the scope of the law and relevant legislation regulating the business set out in the Company's articles of association to which your disclosure of personal data to the Company is subject;
- To comply with information retention, reporting and notification obligations required by official institutions, to fulfil the requirements of contracts and to perform the legal obligations to which the Company is subject in relation to the use of these services;
- To manage the Company's financial operations, communication, market research and corporate responsibility activities, purchasing operations (request, offer, evaluation, order, budgeting, contract), in-house system and application management operations, and legal operations carried out by the Company for the purpose of determining and implementing the Company's commercial and business strategies;
- To comply with applicable laws and regulatory obligations (including those outside your country of residence), including anti-money laundering and counter-terrorism laws, to comply with legal process and to review, evaluate and respond to requests from official and government authorities (including those outside your country of residence).
Your personal data will be processed within the conditions and purposes for the processing of personal data specified in Articles 5 and 6 of Law No. 6698 for the above purposes.
c) To Whom and For What Purpose Processed Personal Data May Be Transferred
Your personal data collected may be transferred to the following, limited to the realisation of the purposes set out above:
- The Company's business partners, suppliers, shareholders and its affiliates;
- Persons or organisations permitted by the provisions of the Tax Procedure Law, Social Security Institution legislation, Court of Accounts, Law on Prevention of Laundering of Proceeds of Crime, Law on Prevention of Laundering of Proceeds of Crime, Turkish Commercial Code, Code of Obligations and other legislation;
- Legally authorised public institutions and organisations, administrative authorities and legal authorities;
- Foreign companies and affiliates;
- Real or legal persons from whom we receive services and with whom we cooperate for product/service comparison, analysis, evaluation, advertising and the realisation of the purposes set out above, programme partner institutions and organisations, institutions with which we have agreements for the sending of messages to our customers, and courier companies that deliver your orders to you.
Transfers may be made within the framework of the conditions and purposes for the processing of personal data specified in Articles 8 and 9 of Law No. 6698.
ç) Method and Legal Reason for Collecting Personal Data
Your personal data is collected by the Company in accordance with the applicable legislation for the purposes set out above and within the performance of the contract, through channels including the Company Head Office, applications made through agreed websites, other institutions to which we provide or from which we receive support services, real and/or legal persons with whom transactions are carried out within the scope of any legislation or contract, our website and mobile application, our call centres and our social media accounts, orally, in writing or in electronic form, or through other channels that may be established or arise in the future.
d) Rights of the Data Subject Under Article 11 of Law No. 6698
As data subjects, if you submit your requests regarding your rights through the methods set out below, the Company will finalise the request as soon as possible and within thirty days at the latest depending on the nature of the request. No fee will be charged for responses up to ten pages. A processing fee of 1 Turkish Lira per page will be charged for each page exceeding ten pages. If the response to the application is provided on a recording medium such as a CD or USB flash drive, the fee that may be requested by our company shall not exceed the cost of the recording medium. In this context, data subjects have the right to:
- Learn whether their personal data is being processed;
- Request information if their personal data has been processed;
- Learn the purpose of processing of personal data and whether they are used in accordance with that purpose;
- Know the third parties to whom personal data has been transferred domestically or abroad;
- Request correction of personal data if it is incomplete or incorrectly processed and request that the third parties to whom the personal data has been transferred be notified of the processing carried out in this context;
- Request deletion or destruction of personal data in the event that the reasons requiring its processing have ceased to exist despite the fact that it has been processed in accordance with Law No. 6698 and other relevant legal provisions, and request that the third parties to whom the personal data has been transferred be notified of the processing carried out in this context;
- Object to the occurrence of a result against the person by means of analysis of the processed data exclusively through automated systems;
- Request compensation for damage in the event of damage due to unlawful processing of personal data.
You may submit your request regarding the exercise of your rights set out above in Turkish and in writing, or by using your registered e-mail (KEP) address, secure electronic signature, mobile signature or the e-mail address previously notified to the Company and registered in our system, in accordance with paragraph 1 of Article 13 of Law No. 6698 and the Communiqué on the Procedures and Principles for Application to the Data Controller (Official Gazette No. 30356 dated 10.03.2018). Only information about the applicant will be provided in applications; it will not be possible to obtain information about other family members and third parties. The Company reserves the right to verify your identity before responding. Your application must include:
- Your name, surname and, if the application is in writing, your signature;
- For Turkish Republic citizens, your Turkish ID number; if you are a foreign national, your nationality, passport number or identity number if any;
- Your residence or business address for service of process;
- Your e-mail address, telephone and fax number for notification, if any;
- The subject of your request;
and it is mandatory that the above be included; any information and documents relating to the subject must also be attached to the application. Depending on the nature of your request, the information and documents that will enable identification must be provided to us completely and accurately. If the requested information and documents are not provided properly, the Company may experience difficulties in conducting the research to be carried out in connection with your request in a complete and qualified manner. In such case, the Company declares that it reserves its legal rights.
